Terms and Conditions of Use and Sale

These Terms and Conditions (the "Terms") govern the use of the ekaia Store application and website (the "Service"), operated by Arvilous S.A. ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms in full. If you do not accept them, please do not use the Service.
**1. Definitions**
- **Platform:** the ekaia Store application and website.
- **User / Customer:** any person using the Service.
- **Seller:** a third-party merchant offering products on the marketplace.
- **Order:** the purchase of one or more products through the Platform.
**2. User Account**
- You must provide accurate and up-to-date information when creating your account.
- You are responsible for keeping your login credentials confidential and for any activity carried out through your account.
- You must be of legal age to enter into a contract, or have authorization from a legal guardian.
- We may suspend or delete an account in the event of a violation of these Terms.
**3. Marketplace and Third-Party Sellers**
ekaia Store is a marketplace connecting customers with independent sellers. Some products are sold directly by third-party sellers. We facilitate the transaction, but responsibility for the description, quality, and compliance of products lies with the relevant seller, unless otherwise required by law.
**4. Orders and Pricing**
- Prices are shown in the displayed currency and may be changed at any time before the order is confirmed.
- We strive to ensure the accuracy of product information, but errors may occur. In the event of an obvious pricing error, we may cancel the order and issue a refund.
- An order is only confirmed once payment has been validated (or, where applicable, upon acceptance of cash-on-delivery payment).
**5. Payment**
Payments are processed through secure payment providers and/or via cash on delivery, depending on the options available. You confirm that you are authorized to use the payment method chosen.
**6. Delivery**
- Delivery times are provided as estimates and may vary depending on location and seller.
- Delivery fees, where applicable, are shown before the order is confirmed.
- Risk related to the products transfers to the Customer upon receipt of the order.
**7. Returns and Refunds**
Return, exchange, or refund requests are handled in accordance with our return policy and the seller's terms. Certain products (e.g., digital products, perishable goods, personalized items) may not be eligible for return. Please contact us with any requests.
**8. User Obligations**
You agree not to:
- Use the Service for illegal or fraudulent purposes.
- Post false reviews, false information, or impersonate another person.
- Disrupt, hack, or attempt to bypass the Platform's security.
- Infringe upon the rights of others or of Arvilous S.A.
**9. Intellectual Property**
The content of the Platform (logos, text, interface, trademarks, including "ekaia Store" and "Arvilous") is protected and belongs to Arvilous S.A. or its partners. Any unauthorized reproduction is prohibited.
**10. Limitation of Liability**
The Service is provided "as is." To the extent permitted by law, Arvilous S.A. shall not be liable for indirect damages resulting from the use or inability to use the Service, nor for disputes directly related to products sold by third-party sellers.
**11. Suspension and Termination**
We may suspend or terminate your access to the Service, without prior notice, in the event of a violation of these Terms or misuse of the Service.
**12. Governing Law**
These Terms are governed by the laws in force in Haiti. Any dispute falls under the jurisdiction of the competent courts of Haiti.
**13. Modifications**
We may modify these Terms at any time. The updated version will be posted on this page with a new date. By continuing to use the Service, you accept the modified Terms.
